SPEC OPS PAINTBALL – TERMS AND CONDITIONS

NOTICE TO USER

Please read this agreement carefully before making your purchase. By selecting “I AGREE,” you confirm that you have read, understood, and accepted these Terms and Conditions. You also confirm that a contract for the sale and supply of services is being formed between you and Spec Ops Paintball. If you are purchasing on behalf of another person, you agree you are acting as their authorised agent.

IMPORTANT NOTICE: These terms affect your legal rights and include exclusions of liability, assumption of risk, and waiver provisions.

1. DEFINITIONS

1.1 “Spec Ops Paintball” or “SOP” means Wanrooy Entertainment t/a Spec Ops Paintball and its employees, directors, and agents.

1.2 “Recreational Services” includes Paintball (using Reball®), Gel Ball, Nerf battles, speedball training, equipment hire, venue use, and all related tactical gaming activities.

1.3 Comprehensive Waiver

2. PARTICIPATION REQUIREMENTS

2.1 Age Requirements

Paintball (Reball®): 15+
Gel Ball: 12+
Nerf Battles: 6+
Proof of age may be required

2.2 Parental Requirements

Participants under 18 must have a parent/guardian complete the waiver and attend check-in
Children 12 and under (Nerf) must have a parent/guardian remain on-site throughout the session

2.3 Arrival Requirements

Participants must arrive at the scheduled session time.
Session time includes check-in, equipment fitting, safety briefing, and gameplay.
Late arrivals may still join after the next safety briefing, but no time extensions or refunds apply.

2.4 Health and Safety

Participants must be in good health and fit to participate
No participation for those under the influence of drugs/alcohol, pregnant, or with high-risk medical conditions
Completion of the Comprehensive Waiver is mandatory before each session

3. ASSUMPTION OF RISK AND LIABILITY

3.1 By booking or participating, you agree to these Terms and the Comprehensive Waiver.

3.2 Recreational activities at SOP involve inherent risks. Injuries, including serious injury or death, may occur. You accept all such risks.

3.3 Australian Consumer Law Notice: Under the ACL, SOP is required to provide services with due care and skill. However, you may waive your right to sue for injury or death under section 22 of the ACL, as outlined in the waiver.

3.4 These exclusions do not apply in cases of SOP’s gross negligence.

3.5 You authorise SOP to take reasonable steps to protect your welfare in an emergency, including administering first aid or arranging ambulance services. You accept responsibility for any associated medical or transport costs.

4. EQUIPMENT AND SAFETY

4.1 Only SOP-provided or approved equipment may be used.

4.2 All personal equipment must be safety-checked by SOP staff.

4.3 Required safety gear must be worn at all times.

4.4 Removing safety gear during gameplay results in immediate ejection without refund.

4.5 Equipment Rules:

Paintball markers: Max 220 FPS (chronographed by SOP staff)
Gel blasters: Contact SOP for FPS session limits
Only SOP-supplied Reballs, gel balls, or Nerf darts allowed

5. CONDUCT AND BEHAVIOUR

5.1 Follow all safety briefings, referee directions, and venue rules.

5.2 Reckless, abusive, unsafe, or unsportsmanlike behaviour leads to immediate ejection without refund.

5.3 Staff decisions are final regarding safety and conduct.

5.4 SOP reserves the right to refuse service at any time.

6. WEBSITE AND PURCHASING

6.1 This site is operated by Spec Ops Paintball, 42 The Terrace, North Ipswich, QLD 4305

6.2 All bookings must include accurate customer details and valid payment.

6.3 Payment must be made via approved online methods or onsite.

6.4 Confirmation will be emailed once payment is received.

6.5 No cancellations after payment except under the Refund & Cancellation Policy.

7. PRICING AND AVAILABILITY

7.1 Prices are in AUD and include GST. A credit card surcharge may apply at checkout depending on the payment method used.

7.2 SOP may cancel a transaction due to pricing errors or session unavailability. Refunds will be processed immediately.

7.3 Product and session details may change without notice to meet operational or legal requirements.

8. TICKETS, PASSES & MEMBERSHIPS

8.1 Tickets remain SOP property and follow the Refund & Cancellation Policy.

8.2 Tickets are non-refundable, non-transferable, and valid only for the booked date, time, and activity.

8.3 Multi-visit passes are subject to their own conditions at time of purchase.

8.4 Memberships follow terms as agreed at the time of joining.

8.5 Lost/damaged tickets or memberships require verification for replacement.

9. PHOTOGRAPHY AND MEDIA

9.1 By entering the premises, you consent to SOP using your image or voice in promotional, marketing, or safety materials.

9.2 To opt out, contact info@specopspaintball.com.au at least 72 hours before your session.

10. PRIVACY AND SECURITY

10.1 Payments are processed through secure third-party gateways.

10.2 SOP uses reasonable measures to secure your data.

10.3 While we take steps to protect your information, we are not liable for breaches caused by circumstances outside our control.

11. MULTI-VISIT PASSES

11.1 Valid for 12 months from date of purchase.

11.2 Non-transferable and linked to the original purchaser.

11.3 Booking is required for each visit.

11.4 Missed bookings are forfeited without refund or credit.

11.5 Additional terms apply at purchase.

12. MEMBERSHIP TERMS

12.1 Memberships are non-refundable and non-transferable.

12.2 Members must still comply with all age, waiver, and safety rules.

12.3 Benefits apply only as advertised and may change.

12.4 Misuse of membership may result in cancellation without refund.

12.5 Additional terms apply at time of joining.

13. LEGAL PROVISIONS

13.1 These Terms are governed by the laws of Queensland and the Commonwealth of Australia.

13.2 All disputes will be heard exclusively in Queensland courts.

13.3 If any provision is found invalid, the rest remain enforceable.

13.4 SOP may update these Terms at any time with reasonable notice.

13.5 These Terms operate alongside the Comprehensive Waiver.
